In 2016, several final rules were issued by the Obama administration that will negatively impact ABC member companies.  ABC General Counsel Maury Baskin will provide an overview of the final rules as well as an update on ABC legal challenges. 
 
In addition, Maury Baskin will discuss the election results and what ABC members should expect under a new administration regarding potential legislative and regulatory actions in 2017. 
 
 The webinar will cover the following final rules and legal challenges:
 

  • DOL: Persuader Final Rule.  The rule was scheduled to go into effect July 1, 2016, however, on June 27, the U.S. District Court for the Northern District of Texas issued a nationwide preliminary injunction that blocks the DOL from implementing the final persuader rule. ABC is currently litigating the final rule.
  • OSHA:  Electronic Injury Reporting and Anti-retaliation Final Rule. The reporting requirements go into effect Jan. 1, 2017. On Oct. 18, OSHA further agreed to delay the anti-retaliation provisions until Dec. 1.  It is the second delay of the anti-retaliation provisions, which were originally scheduled to go into effect Aug. 10, 2016. OSHA had previously agreed to delay until Nov. 10. ABC filed a lawsuit against the anti-retaliation provisions of the final rule.
  • FAR and DOL:  Blacklisting Final Rule and Guidance. On Oct. 24, the U.S. District Court for the Eastern District of Texas issued a nationwide preliminary injunction that prevents the Federal Acquisition Regulatory (FAR) Council from implementing the final blacklisting rule, officially titled Fair Pay and Safe Workplaces, which was scheduled to go into effect on Oct. 25. (Note: the preliminary injunction does not block implementation of the paycheck transparency provisions of the final rule, which are still scheduled to take effect on or after Jan. 1, 2017). ABC is currently litigating the final rule.
  • OSHA:  Respirable Crystalline Silica Final Rule.  Construction employers must comply with the requirements of the standard by June 23, 2017, except for requirements for laboratory evaluation of exposure samples, effective June 23, 2018. ABC is currently litigating the final rule.
  • DOL:  Overtime Final Rule.  The final rule is scheduled to take effect on Dec. 1, 2016. Automatic updates to the standard salary level will occur every three years, beginning on Jan. 1, 2020. ABC is currently litigating the final rule.
  • DOL:  Paid Sick Leave Final Rule. The final rule is effective Nov. 29, 2016 and applies to covered federal contracts where the solicitation of the contract has been issued, or the contract has been awarded outside the solicitation process, on or after Jan. 1, 2017.
